Germany<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ca5c2dc elementor-widget elementor-widget-text-editor\" data-id=\"ca5c2dc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>1. general contractual provisions<\/h3><p>The following terms and conditions are part of the contract by mutual agreement. They have been brought to the attention of the customer and are recognized by him upon acceptance of the order confirmation or signing of the order. In the case of telephone orders, the General Terms and Conditions shall be deemed to have been accepted by the customer at the latest upon receipt of our goods or acceptance of our services. All our deliveries and services, including future deliveries and services, are provided exclusively on the basis of the following terms and conditions. Any deviating terms and conditions of purchase of the customer are hereby rejected; they shall not be valid, even if reference was made to other terms and conditions of purchase when the order was placed.    <\/p><p> <\/p><h3>2. offers and conclusion of contract<\/h3><p>Our offers are subject to change and non-binding. The documents, illustrations, drawings and plans belonging to the offer, including the dimensions, are only approximate unless they are expressly marked as binding. Errors in offers, catalogs, order confirmations and invoices, calculation and typing errors do not oblige us to pay compensation. We expressly reserve the right to make changes to the technical design and equipment. The documents provided to the customer, such as drawings, models, drafts and calculations, remain our property until the order is effectively placed. If the order is not placed, Erdmann is entitled to reclaim all documents. The customer is not authorized to publish these documents without our agreement, to duplicate or to use for another than the agreed purpose.      <\/p><p>Verbal side agreements become effective only by our written confirmation. Subsequent changes or extensions of the order by the buyer can be considered by Erdmann-Sauna only within 8 working days after sending the order confirmation (the date of the order confirmation is valid). <\/p><p>We reserve the right to make all changes that serve technical progress, even after the order confirmation. The drawings, illustrations and dimensions attached to the offers and order confirmations are only binding insofar as no subsequent changes are made by the customer, official regulations are changed or newly issued, or changes occur in the design. <\/p><p> <\/p><h3>3. prices<\/h3><p>The prices contained in the offer and the order confirmation of the company Erdmann are valid for the duration of four months. The company Erdmann-Sauna reserves itself the right to increase the prices for delivery or assembly of the ordered or ordered goods after the expiration of this period in application to the usual market tendencies. The prices of the company B.Erdmann-Saunabau understand themselves as net prices, if nothing else has been agreed in writing. A set-off is entitled to the customer only if his counterclaims are judicially determined or undisputedly recognized by the company Erdmann.    <\/p><p> <\/p><h3>4. reservation of right of amendment<\/h3><p>Goods manufactured in series are sold by sample. Customary deviations, in particular for wooden surfaces, are reserved. <\/p><p> <\/p><h3>5. delivery<\/h3><p>Unless otherwise agreed in writing, the delivery time for our products is approx. 4 weeks. In the case of call orders, the desired delivery date must be specified in writing by the customer three weeks in advance. We shall endeavor to adhere to the specified delivery periods. If the delivery deadline is exceeded, the customer shall in any case grant us a reasonable grace period. Claims for damages on the part of the customer due to delayed delivery shall be excluded in the event of simple negligence if the customer is a merchant; otherwise, liability shall be limited to a maximum amount of \u20ac 500.00. Liability for delays in delivery that     <\/p><p>a) occur due to work stoppages, lockouts and cases of force majeure or are otherwise based on an unforeseen event or an event for which we are not responsible and lead to serious operational disruptions for us or for a sub-supplier<\/p><p>b) occur due to impossibility of delivery by the upstream supplier<\/p><p>c) are based on circumstances for which we are not responsible,<\/p><p>do not exist. In such cases, the delivery time shall be extended accordingly. In addition, we have the right to withdraw from the contract in whole or in part. If a delivery made on the basis of an order confirmed by us is not accepted by the customer for reasons for which we are not responsible, we shall be entitled either to demand payment of the invoice amount step by step against deduction of the delivery after setting a deadline or to withdraw from the contract. In the event of withdrawal, the separate provisions set out in these General Terms and Conditions shall apply.    <\/p><p> <\/p><h3>6 Delivery obligation, withdrawal<\/h3><p>B.Erdmann assumes the solvency and creditworthiness of the buyer when accepting the order. If circumstances arise during the term of the contract that give reasonable cause for doubt about the solvency of the buyer, in particular if the buyer suspends his payments or lets bills of exchange go to protest, the company Bernd Erdmann-Saunabau is entitled to make the delivery dependent on the advance payment of the purchase price or security deposit within a period set by the company Bernd Erdmann-Saunabau. <\/p><p>After expiry of the deadline, we are entitled to withdraw from the contract and demand compensation for non-performance.<\/p><p>The buyer can withdraw from the contract if company Bernd Erdmann-Saunabau written grace period for delivery is set and this is exceeded by us by more than three months. If the buyer withdraws from the contract for reasons for which we are not responsible, we reserve the right to charge the costs incurred up to the time of withdrawal for planning, work preparation, wages and materials, as well as the loss of profit, at least 40% for custom-made, line and special production, unless the buyer can prove that the damage is lower. We expressly reserve the right to assert further claims for damages.   <\/p><p> <\/p><h3>7. assembly and acceptance<\/h3><p>Assembly shall take place after prior written and telephone notification. The designated assembly room must be clean and tidy. We do not accept any responsibility or liability for the suitability of the installation room. Waiting times as well as all delays and additional costs caused by sloping walls, sloping floors or similar will be charged separately, unless this has already been taken into account in the offer through corresponding price surcharges.   <\/p><p>The client undertakes to complete all on-site work before the agreed installation date. It must be ensured that sufficiently wide doors, stairs and corridors are available for the installation of the saunas and steam baths up to the installation site, unless otherwise agreed, at least 80 cm. The sauna installation site must be swept clean upon delivery. The floor in the sauna area, the electrical installation and the preparatory work required for the connection of the ventilation system must be completed by the agreed installation date. The electrical installation must be carried out according to our instructions by locally authorized electrical contractors. All sanitary installations are to be installed by the customer after consultation. The costs for this are not included in our prices. Work required for installation, such as sawing and drilling, must be feasible at the installation site.       <\/p><p>The customer is obliged to accept the work of the company Bernd Erdmann-Saunabau as soon as he has been notified of the completion. <\/p><p>The customer is obliged to appear for acceptance at the end of installation or to be represented. If the customer does not attend the acceptance appointment and does not allow himself to be represented, the installation work shall be deemed to have been accepted. <\/p><p>Any complaints must be reported immediately.<\/p><p>If the customer instructs the company Bernd Erdmann-Saunabau to provide the service directly to the contractual partner of the customer, the acceptance of the work of the company Erdmann-Sauna by the contractual partner of the customer replaces the acceptance of the services of the company Bernd Erdmann-Saunabau by the customer. <\/p><p> <\/p><h3>8. transfer of risk<\/h3><p>The risk of having to pay the purchase price despite loss or damage shall pass to the buyer upon delivery of the ordered goods. If the company Bernd Erdmann-Saunabau has taken over the assembly of the ordered goods, the transfer of risk shall take place upon acceptance of the assembly work. <\/p><p> <\/p><h3>9. terms of payment<\/h3><p>Unless otherwise agreed in writing, payments are to be made to the supplier immediately after completion of installation without any deductions.<\/p><p>If the target is exceeded, we are entitled, without the need for a reminder, to charge default interest at the usual bank rate, but at least 5% above the respective prime rate of the European Central Bank. <\/p><p>Checks are only accepted on account of performance and are not considered payment until they have been cashed. <\/p><p>The acceptance of bills of exchange is excluded unless otherwise agreed in writing. In the event of default in payment and in the event of considerable doubt as to the solvency or creditworthiness of our customer, e.g. in the event of a check protest, all our outstanding claims shall become due immediately. In the case of custom-made products or orders in excess of EUR 5,000.00, a down payment of 50% of the order value must be made immediately when the order is placed. A further 30% of the order value shall be due for payment upon notification of readiness for dispatch or before the start of assembly. The remaining 20% shall be paid after completion of the service (completion of installation) and is due for payment within 8 days.    <\/p><p> <\/p><h3>10. default of acceptance<\/h3><p>The buyer is obliged to accept the ordered goods immediately after delivery.<\/p><p>In the case of call-off orders, the goods must be called off after three months at the latest. Delivery on call is subject to the respective operational delivery time. <\/p><p>If the journey to the buyer is in vain because he is not present, a reimbursement amount of \u20ac 0.51 per kilometer, but at least \u20ac 15.34, shall be deemed agreed.<\/p><p>Provided that the buyer remains silent on a grace period set to him for acceptance, refuses acceptance or expressly declares not to want to accept, the company Erdmann-Sauna is entitled to claim damages for non-performance. If the delay in acceptance lasts longer than two weeks, the buyer has to pay incurred storage costs. <\/p><p> <\/p><h3>11. notices of defects<\/h3><p>For recognizable defects, the company Erdmann-Sauna assumes liability for sauna systems, ovens and tanning devices only if the buyer has notified the defects within 1 day after the occurrence of the defect, in the case of individual deliveries at the latest 1 day after delivery, with an exact description of the complaint of the company Bernd Erdmann-Saunabau. Notices of defects must be made in writing. <\/p><p> <\/p><h3>12. warranty<\/h3><p>We provide the agreed services in accordance with the state of the art applicable at the time of commissioning and the relevant legal provisions and with the care customary in the industry.<\/p><p>We guarantee that the goods supplied by us have no material or processing defects that could impair their function. Changes to the wood we use are possible due to the high temperatures. Insofar as this does not go beyond what is usual in sauna construction, we do not assume any warranty for this.  <\/p><p>Furthermore, we do not assume any warranty<\/p><p>&#8211; if the equipment has been handled and operated improperly and not in accordance with the instructions provided by us, or if any modifications have been made or other damage has occurred.<\/p><p>&#8211; for all damage caused by the effects of water and moisture.<\/p><p>If the transaction is a commercial transaction for both parties, we shall assume warranty for defective delivered goods by providing a replacement delivery free of charge within a reasonable period of time for us or compensation for any reduced value. Warranty periods shall not be extended by this. Removal and installation costs shall be borne by the customer and are included in the dealer discount granted.  <\/p><p>The warranty liability towards end consumers remains unaffected by this.<\/p><p>The customer is entitled to demand a reduction of the price (price reduction) if the rectification of defects repeatedly fails within a reasonable period of time or if the repeated replacement delivery does not remedy the defect. Further claims for compensation are excluded. <\/p><p>With sample parts and special offers the guarantee of the company Erdmann-Sauna is limited to rework.<\/p><p>Until the defect has been remedied, the customer is entitled to retain an appropriate security (max. 10% of the purchase price).<\/p><p>Sauna systems manufactured by Erdmann are guaranteed for 5 years for privately used systems. The electrical devices supplied with the privately used sauna are guaranteed for 2 years. For commercial installations, we grant a guarantee of 2 years on the sauna system and 2 years on the electrical equipment supplied.  <\/p><p> <\/p><h3>13 Erdmann warranty &#8211; Warranty conditions<\/h3><p>The warranty is only valid if<\/p><ul><li>the Erdmann Saunabau products are installed by Erdmann Saunabau or a specialist company authorized by Erdmann Saunabau.<\/li><li>the care and cleaning instructions as well as the operating instructions are observed.<\/li><li>the installation instructions and installation notes are observed for self-assembly.<\/li><\/ul><p>The following are excluded from the guarantee<\/p><ul><li>Parts that are subject to natural wear and tear (e.g. light sources, silicone joints, etc.)<\/li><li>Defects or damage caused by improper use or utilization.<\/li><li>Color changes of woods, as every wood changes its color due to the effect of light, for example.<\/li><\/ul><p>The guarantee takes place in such a way that Erdmann Saunabau repairs the defective part free of charge or replaces it with flawless parts at the discretion of Erdmann Saunabau. Replaced parts become the property of Erdmann Saunabau. <\/p><p>The warranty claim must be made to Erdmann Saunabau within the warranty period. An invoice showing the delivery date is required for this. <\/p><p>Warranty services neither extend nor renew the warranty period. The warranty period for installed spare parts ends with the warranty period for the entire Erdmann Saunabau product. <\/p><p>Further or other claims than mentioned in these guarantee conditions, in particular those for compensation for damages incurred outside the Erdmann Saunabau guarantee product, are excluded, insofar as liability is not mandatory by law.<\/p><p>By this warranty rights of the customer from the general terms of delivery of Erdmann Saunabau and legal rights are not limited.<\/p><p>The Erdmann Saunabau guarantee only applies to saunas that are installed in Germany.<\/p><p> <\/p><h3>14. materials and patterns<\/h3><p>In the case of natural products such as wood and natural stone, deviations in color, grain, texture and structure may be possible compared to the samples or exhibition booths. This does not constitute a defect. Typical wood ingrowths, grains and color differences correspond to the natural properties of the wood used and are not defects. Dimensional tolerances that correspond to the applicable DIN standards or specific properties of the materials used are permissible. In the case of glass elements, hairline scratches, bubbles and inclusions that do not affect the strength are permissible.    <\/p><p> <\/p><h3>15 Retention of title<\/h3><p>Until full payment of the claims of the company Bernd Erdmann-Saunabau against the buyer from the business relationship, the goods sold remain the property of the company Bernd Erdmann-Saunabau.<\/p><p>During the period of retention of title, the buyer is entitled to possession and use of the object of purchase as long as he is not in default of payment. If the buyer is in default of payment or if he violates his obligations under the retention of title, the company Bernd Erdmann-Saunabau may demand the return of the object of purchase. <\/p><p>In the event of access by third parties, in particular in the event of seizure of the object of purchase, the customer shall immediately notify the company Bernd Erdmann-Saunabau in writing and immediately inform the third party of the retention of title of the company Bernd Erdmann-Saunabau. The buyer shall bear all costs that must be incurred to cancel the seizure and to replace the object of purchase. The retention of title also extends to the new item created by processing, mixing or combining the goods delivered by the company B. Erdmann-Saunabau, whereby B. Erdmann-Saunabau is considered the manufacturer. If the processing, mixing or connection takes place with goods, at which property rights of third parties exist, then the company B. Erdmann-Saunabau acquires proportionate co-ownership.      <\/p><p> <\/p><h3>16. limitation of liability<\/h3><p>Our employees provide non-binding advice on all technical issues relating to the installation or fitting of our systems or appliances. In individual cases, special problems (e.g. building physics, ventilation) cannot be ruled out. <\/p><p>We cannot accept any liability, including liability for consequential damage, for any information provided by our employees that does not directly relate to the technical requirements for the installation or assembly of our appliances without written confirmation. If, after ordering or installation, additional measures are required by the authorities which go beyond the generally known state of the art or local regulations, any modification costs incurred shall be borne by the purchaser. <\/p><p> <\/p><h3>17 Place of fulfillment and jurisdiction<\/h3><p>The place of performance for delivery and payment is the registered office of Bernd Erdmann-Saunabau.<\/p><p>The place of jurisdiction is at our discretion in 08525 Plauen. If the buyer is a merchant or legal entity, the place of jurisdiction is the respective registered office of Bernd Erdmann-Saunabau.  <\/p><p> <\/p><h3>18. final provision<\/h3><p>Should a provision of these agreements be or become invalid, this shall not affect the validity of the remaining provisions.
